Website Hosting Terms and Conditions

This contract is a legal agreement between  YOUR COMPANY (herein known after as “customer” and Web Precision Internet Services.

 The following terms and conditions apply to all WEB PRECISION customers. WEB PRECISION will provide World Wide Web Internet Services to the customer in exchange for payment of fees and compliance with the terms and conditions of the agreement.

Service payments of $200.00 will be submitted annually or $75 quarterly in advance of the service period.

 Each website includes 50 megabytes of storage space. Customer agrees to pay $50 for an additional 100mb storage or $100 per year for an additional 500mb.

 Each website is allowed 5 Gigabytes of download traffic per month. Additional traffic will be charged at $3 per gigabyte of portion thereof.

 WEB PRECISION does not police, censor, or control the content of the information stored under customers WEB PRECISION account. Customer is completely and solely responsible for the content of the information and files stored in customers WEB PRECISION account. Customer is also

completely responsible for maintaining the privacy of any files under customers account and the security of customers account and it password(s). Customer will be liable for all resource fees incurred under

Customer’s account.

 WEB PRECISION makes no warranties of any kind, whether expressed or implied,

for the service it is providing. Internet technology is an ongoing development and some downtime and maintenance is normal during operations. WEB PRECISION also disclaims any warranty of merchantability or fitness for any particular purpose of services provided. WEB PRECISION will not be held responsible for any damages customer suffers or inflicts upon another party.

This includes loss resulting from service interruption, delays, non-deliveries or mis-deliveries caused by WEB Precision’s negligence or customer's own actions and/or errors. Customer is responsible for keeping a backup copy of customer’s WEB PRECISION files elsewhere to enable customer

to recover in the event of loss or damage to customer’s file. If WEB PRECISION is responsible for loss or damage to files every attempt will be made to recover them from backups. However, if customer fails to adequately backup customer’s account and any loss or damage of customer’s files occurs resulting from customer’s own error or vandalism to customer’s account due to customer’s failure to adequately secure account, a fee of $50 will be required to recover customer’s files from the most recent WEB PRECISION backup. WEB PRECISION makes no guarantee, express or implied, of its ability to recover any file, regardless of whether loss or damage is the fault of WEB PRECISION, customer, or another party.

 Customer agrees to submit payment of all invoices upon receipt. Accounts not paid by the 15th day of the service period are subject to deletion from WEB Precision’s computer system. Termination and/or deletion does not relieve Customer of the obligation to remit any outstanding balance. Customer agrees

to reimburse WEB PRECISION or its collection agent(s) for all collections costs, including all court and attorneys fees  if account is delinquent for more than 90 days. WEB PRECISION reserves the right to charge late fees to the maximum extent permitted by law. Sites suspended due to past due balance will be assessed a $25.00 service restoration fee for reconnection.

 Submission of credit card information to WEB PRECISION constitutes authorization by customer for WEB PRECISION to bill the specified credit card for all fees owed by customer to WEB PRECISION according to the terms of this agreement.

 WEB PRECISION has a NO REFUNDS policy. WEB PRECISION reserves the right to change rates and otherwise modify these terms and conditions and will provide customer with thirty days notice in advance of the effective date of change.

 WEB PRECISION operates its services subject to and in accordance with all applicable local, state, and federal laws.  Customer agrees to abide by all applicable local, state, and federal laws. Customer agrees to indemnify and hold WEB PRECISION harmless from any civil claims or criminal charges

resulting from service which causes direct or indirect damage to another party or violates any law. Customer also agrees to indemnify and hold WEB PRECISION harmless from any and all lawsuits, judgments, and decrees, costs and expenses, and attorney fees arising from customer’s use of services provided.

 CUSTOMER agrees to settle any disputes with WEB PRECISION through arbitration in Orange County California.

 WEB PRECISION reserves the right to refuse service to any individual or organization for any reason not prohibited by law. WEB PRECISION also reserves the right to terminate existing service to any individual or organization for any reason not prohibited by law.

 This agreement represents the complete agreement and understanding between WEB PRECISION and customer with respect to the subject matter herein, and supersedes any and all previous representations, understandings, or agreements, whether written, oral or otherwise, and shall prevail notwithstanding any variance with terms and conditions of any order submitted.

 Use of WEB Precision’s services constitutes acceptance of these terms and conditions.
